A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the transfer of territory between junior college |
|
district service areas. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter J, Chapter 130, Education Code, is |
|
amended by adding Section 130.1615 to read as follows: |
|
Sec. 130.1615. TRANSFER OF SCHOOL DISTRICT TO NEW SERVICE |
|
AREA. (a) Notwithstanding any other provision of this subchapter, |
|
the board of trustees of an independent school district by |
|
resolution may transfer the territory of the school district from |
|
the service area of one junior college district to the service area |
|
of another junior college district if: |
|
(1) the board of trustees finds that another junior |
|
college district is willing to provide service to the residents of |
|
the school district and: |
|
(A) offers more affordable services; |
|
(B) offers a broader or more relevant selection |
|
of courses or programs; or |
|
(C) is otherwise better suited to meet the needs |
|
of the residents of the school district; and |
|
(2) the territory included in the service areas of the |
|
affected junior college districts is contiguous. |
|
(b) A transfer under this section does not affect the |
|
territory of an independent school district that is located within |
|
the boundaries of the taxing district of a junior college district. |
|
(c) A junior college district may continue to treat an area |
|
removed from the district's service area under this section as if |
|
the area were still in the district's service area during the first |
|
academic year following the adoption of the resolution as necessary |
|
to avoid an unreasonable interruption of junior college services in |
|
the area. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2015. |
