A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to overtime pay for certain information technology state |
|
employees. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 659.015(i), Government Code, is amended |
|
to read as follows: |
|
(i) With authorization from the administrative head of the |
|
agency for which an employee works, or that person's designee, an |
|
employee may be paid an amount based on the employee's regular rate |
|
of pay for: |
|
(1) the hours of compensatory time the employee earns |
|
for work directly related to a disaster or emergency declared by the |
|
appropriate officer of the state or federal government; or |
|
(2) all or part of the hours of compensatory time the |
|
employee earns for work in an information technology position |
|
requiring skills in high demand in the information technology labor |
|
market. |

SECTION 2. Section 659.016(i), Government Code, is amended |
|
to read as follows: |
|
(i) Except as provided by this subsection and Subsection |
|
(j), an employee covered by this section may not be paid for any |
|
unused compensatory time. With authorization from the |
|
administrative head of the agency for which a state employee works, |
|
or that person's designee, an employee may be paid an amount based |
|
on the employee's regular rate of pay for: |
|
(1) the hours of compensatory time the employee earns |
|
for work directly related to a disaster or emergency declared by the |
|
appropriate officer of the state or federal government; or |
|
(2) all or part of the hours of compensatory time the |
|
employee earns for work in an information technology position |
|
requiring skills in high demand in the information technology labor |
|
market. |
|
SECTION 3. The changes in law made by this Act apply only to |
|
compensatory time earned on or after the effective date of this Act. |
|
SECTION 4. This Act takes effect September 1, 2015. |
