A BILL TO BE ENTITLED
 
AN ACT
  relating to the authority of certain independent school districts
  to change the length of the terms of office for the board of
  trustees of the district.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 11.059(e), Education Code, is amended to
  read as follows:
         (e)  Except as provided by Section 11.0591, not [Not] later
  than December 31, 2011, the board of trustees may adopt a resolution
  changing the length of the terms of its trustees. The resolution
  must provide for staggered terms of either three or four years and
  specify the manner in which the transition from the length of the
  former term to the modified term is made. The transition must begin
  with the first regular election for trustees that occurs after
  January 1, 2012, and a trustee who serves on that date shall serve
  the remainder of that term. This subsection expires January 1,
  2017.
         SECTION 2.  Subchapter C, Chapter 11, Education Code, is
  amended by adding Section 11.0591 to read as follows:
         Sec. 11.0591.  TERMS FOR CERTAIN SCHOOL DISTRICTS. (a) This
  section applies only to a school district that is located in a
  county that is:
               (1)  adjacent to a county with a population of at least
  1.7 million;
               (2)  less than 150 miles from an international border
  and the Gulf of Mexico; and
               (3)  located along State Highway 16.
         (b)  The board of trustees of a school district subject to
  this section may adopt a resolution changing the length of the terms
  of its trustees. The resolution must provide for staggered terms of
  either three or four years and specify the manner in which the
  transition from the length of the former term to the modified term
  is made.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2015.
