A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the construction or development of certain continuing |
|
|
care facilities. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter A, Chapter 246, Health and Safety |
|
|
Code, is amended by adding Section 246.008 to read as follows: |
|
|
Sec. 246.008. CONSTRUCTION OR DEVELOPMENT OF CERTAIN |
|
|
FACILITIES. (a) This section applies only to a facility located in |
|
|
the extraterritorial jurisdiction of a municipality with a |
|
|
population of more than 775,000. |
|
|
(b) Notwithstanding Chapter 245, Local Government Code, a |
|
|
person that has obtained a permit as described by Section 245.001, |
|
|
Local Government Code, including approval of a site plan, for a |
|
|
facility from a municipality may develop the site in accordance |
|
|
with the municipal ordinances, regulations, and rules, including an |
|
|
impervious lot coverage regulation, in effect on the earlier of the |
|
|
date the original permit was issued or the site plan was approved |
|
|
and notwithstanding the issuance of a subsequent permit or a change |
|
|
in those ordinances, regulations, or rules. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2015. |
