A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to permitting for injection wells in certain oil and gas |
|
|
producing counties. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 27, Subchapter C, Water Code, is amended |
|
|
by adding Section 27.0331 as follows: |
|
|
Sec. 27.033. LETTER FROM LOCAL GOVERNING BODY. A person |
|
|
making application to the railroad commission for an oil and gas |
|
|
waste disposal well permit for a location within a Railroad |
|
|
Commission of Texas oil and gas division district with 315 or more |
|
|
total completions in the preceding year shall submit with the |
|
|
application a letter of support or opposition from the governing |
|
|
body of the county in which the well is to be located. The letter |
|
|
should state with specificity the reasons the governing body |
|
|
supports or opposes the proposed well. The Railroad Commission |
|
|
shall consider the letter in determining whether the issuance of |
|
|
the permit is in the public interest. |
|
|
SECTION 2. This Act takes effect September 1, 2013. |
