A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to a federal waiver to allow the Texas Education Agency to |
|
|
administer annual assessment instruments based on modified |
|
|
achievement standards for certain public school students. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Not later than January 1, 2016, the Texas |
|
|
Education Agency shall apply to the United States Department of |
|
|
Education for a waiver of the federal prohibition on the use of |
|
|
annual assessment instruments based on modified achievement |
|
|
standards for students served by special education services. |
|
|
SECTION 2. After receiving the waiver requested under |
|
|
Section 1 of this Act, the Texas Education Agency shall administer |
|
|
the STAAR-M assessment instrument to eligible special education |
|
|
students beginning with the 2016-2017 school year. |
|
|
SECTION 3. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2015. |
