A BILL TO BE ENTITLED

AN ACT
|
|
relating to the powers, rights, and duties of the Fort Bend County |
|
Levee Improvement District No. 2. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subtitle E, Title 6, Special District Local Laws |
|
Code, is amended by adding Chapter 7810 to read as follows: |
|
CHAPTER 7810. FORT BEND COUNTY LEVEE IMPROVEMENT DISTRICT NO. 2 |
|
SUBCHAPTER A. GENERAL PROVISIONS |
|
Sec. 7810.001. DEFINITION. In this chapter, "district" |
|
means the Fort Bend County Levee Improvement District No. 2. |
|
SUBCHAPTER B. POWERS AND DUTIES |
|
Sec. 7810.051. USE OF STATE WATER IN DISTRICT DITCH; PERMIT |
|
NOT REQUIRED. The district may use water that overflows from Brooks |
|
Lake into district Ditch H to irrigate the district's levee to |
|
prevent cracking or other compromise of the structural integrity of |
|
the levee caused by desiccation resulting from insufficient |
|
rainfall or drought. The district is not required to secure a |
|
permit from the Texas Commission on Environmental Quality to use |
|
the water in Ditch H for the purpose described by this section. |
|
SECTION 2. Fort Bend County Levee Improvement District |
|
No. 2 retains all rights, powers, privileges, authority, duties, |
|
and functions that it had before the effective date of this Act. |
|
SECTION 3. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2015. |
