A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to rights to appeal rate and damage schedule |
|
|
determinations by the Board of Regents governing certain easements |
|
|
or other interests in land of The University of Texas System. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 66.46(m), Education Code, is amended to |
|
|
read as follows: |
|
|
(m) the board of regents shall establish procedures by which |
|
|
a person seeking an easement or other interest under this section |
|
|
may seek relief from a rate or damage schedule that the person |
|
|
believes does not represent the fair market value of the interest |
|
|
being sought. Within 30 days of receiving notice of the board of |
|
|
regents' final determination, a person aggrieved by the final |
|
|
determination my appeal to a district court in a county in which the |
|
|
easement or other interest is located, for de novo review. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2015. |
