A BILL TO BE ENTITLED

|
AN ACT
|
|
|
relating to certain land use regulations for land annexed by a |
|
|
municipality for limited purposes. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter F, Chapter 43, Local Government Code, |
|
|
is amended by adding Section 43.1305 to read as follows: |
|
|
Sec. 43.1305. EFFECT OF ANNEXATION ON LAND USE REGULATION. |
|
|
(a) A municipality may not enforce an ordinance or rule that |
|
|
limits the number of people who may assemble on property located in |
|
|
an area that the municipality annexed for limited purposes if the |
|
|
ordinance or rule would restrict the number of people authorized to |
|
|
assemble on the property to less than what the fire prevention |
|
|
authority with jurisdiction over the property has authorized by |
|
|
permit. |
|
|
(b) In this section, "fire prevention authority" means a |
|
|
county fire marshal, a municipal fire department, an emergency |
|
|
services district, or any local agency that provides emergency |
|
|
medical services to the area. |
|
|
SECTION 2. This Act takes effect September 1, 2015. |
