A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to parties who may bring suit under the Texas Free |
|
|
Enterprise and Antitrust Act of 1983. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 15.21, Business & Commerce Code, is |
|
|
amended by adding Subsection (d) to read as follows: |
|
|
(d) A person whose business or property has been injured by |
|
|
reason of any conduct prohibited or declared unlawful by this |
|
|
chapter may sue another person as provided by this section, |
|
|
regardless of whether the injured person dealt directly or |
|
|
indirectly with the defendant. |
|
|
SECTION 2. Section 15.21(d), Business & Commerce Code, as |
|
|
added by this Act, applies only to a cause of action that occurred |
|
|
on or after the effective date of this Act. |
|
|
SECTION 3. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2015. |
