A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to seeking federal authorization to fund the Medicaid |
|
|
program through a block grant funding system. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subtitle I, Title 4, Government Code, is amended |
|
|
by adding Chapter 540 to read as follows: |
|
|
CHAPTER 540. FEDERAL WAIVER FOR BLOCK GRANT FUNDING OF MEDICAID |
|
|
PROGRAM |
|
|
Sec. 540.001. DEFINITION. In this chapter, "Medicaid |
|
|
program" means the medical assistance program established under |
|
|
Title XIX, Social Security Act (42 U.S.C. Section 1396 et seq.). |
|
|
Sec. 540.002. FEDERAL AUTHORIZATION FOR BLOCK GRANT FUNDING |
|
|
SYSTEM FOR MEDICAID PROGRAM. Notwithstanding any other law, the |
|
|
executive commissioner shall negotiate with the United States |
|
|
secretary of health and human services, the federal Centers for |
|
|
Medicare and Medicaid Services, and other appropriate persons for |
|
|
purposes of seeking a waiver or other authorization necessary to |
|
|
operate the Medicaid program under a block grant funding system. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2015. |
