A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to assignment and appeal of public school district and |
|
|
campus performance ratings. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 39.054, Education Code, is amended by |
|
|
adding Subsection (a-2) to read as follows: |
|
|
(a-2) The commissioner, in evaluating school district or |
|
|
campus performance, may not assign a district or campus a rating |
|
|
under Subsection (a) if data quality or integrity is compromised. |
|
|
The commissioner must designate the district or campus as "Not |
|
|
rated: Data integrity issues." |
|
|
SECTION 2. Section 39.151(c), Education Code, is amended to |
|
|
read as follows: |
|
|
(c) A [The commissioner may limit a challenge under this
|
|
|
section to a written submission of any issue identified by the] |
|
|
school district or open-enrollment charter school is entitled to |
|
|
appear before the committee relating to a challenge under this |
|
|
section [challenging the agency decision]. |
|
|
SECTION 3. This Act applies beginning with the 2015-2016 |
|
|
school year. |
|
|
SECTION 4. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2015. |
