A BILL TO BE ENTITLED

|
AN ACT
|
|
|
relating to the suspension of an election judge or clerk. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter C, Chapter 32, Election Code, is |
|
|
amended by adding Section 32.0553 to read as follows: |
|
|
Sec. 32.0553. SUSPENSION OF ELIGIBILITY FOR VIOLATION. (a) |
|
|
The secretary of state shall adopt rules and procedures to allow the |
|
|
official administering an election to immediately suspend and |
|
|
replace an election judge or clerk who fails to comply with the |
|
|
provisions of this code. |
|
|
(b) The rules and procedures adopted under this section must |
|
|
include a process for a review and reinstatement of a suspended |
|
|
election judge's or clerk's eligibility if the election judge or |
|
|
clerk is not finally convicted of an offense in connection with the |
|
|
violation. |
|
|
SECTION 2. This Act takes effect September 1, 2015. |
