A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to erecting certain signs on private property before an |
|
|
election. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 391.005, Transportation Code, is amended |
|
|
to read as follows: |
|
|
Sec. 391.005. EXEMPTION. This chapter does not apply to a |
|
|
sign erected solely for and relating to a public election if the |
|
|
sign: |
|
|
(1) is on private property; |
|
|
(2) is erected not earlier than the 90th day before: |
|
|
(A) the date of the election; or |
|
|
(B) the first day of the early voting period for |
|
|
an election with early voting; |
|
|
(2-a) [and] is removed not later than the 10th day |
|
|
after the election date; |
|
|
(3) is constructed of lightweight material; and |
|
|
(4) has a surface area not larger than 50 square feet. |
|
|
SECTION 2. The change in law made by this Act applies only |
|
|
to an offense committed on or after the effective date of this Act. |
|
|
An offense committed before the effective date of this Act is |
|
|
governed by the law in effect on the date the offense was committed, |
|
|
and the former law is continued in effect for that purpose. For |
|
|
purposes of this section, an offense was committed before the |
|
|
effective date of this Act if any element of the offense was |
|
|
committed before that date. |
|
|
SECTION 3. This Act takes effect September 1, 2015. |
