A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to approval by the commissioner of education of an |
|
|
expansion or new school amendment for a charter holder previously |
|
|
denied a charter by the State Board of Education. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 12.114, Education Code, is amended by |
|
|
adding Subsection (d) to read as follows: |
|
|
(d) The commissioner may not approve a request for an |
|
|
expansion or new school amendment submitted by a charter holder |
|
|
under Subsection (c) if the State Board of Education has previously |
|
|
voted against the grant of a new charter as provided by Section |
|
|
12.101(b-0) for an identical or substantially similar campus |
|
|
submitted by the charter holder or an affiliate of the charter |
|
|
holder. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2015. |
