A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the awarding of attorney's fees in election contest |
|
|
lawsuits. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 231.002, Election Code, is amended to |
|
|
read as follows: |
|
|
(a) Sec. 231.002. APPLICABILITY OF RULES GOVERNING CIVIL |
|
|
SUITS. Except as otherwise provided by this subtitle, the rules |
|
|
governing civil suits in the district court apply to an election |
|
|
contest in the district court, specifically the awarding of |
|
|
attorney's fees and costs of suit as per the governing rules of |
|
|
civil suits in district court. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2015. |
