A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the adoption or enforcement of laws relating to labor by |
|
a political subdivision. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Chapter 1, Labor Code, is amended by adding |
|
Section 1.005 to read as follows: |
|
Sec. 1.005. CONFORMITY OF LOCAL LAW TO STATE LAW. (a) |
|
Notwithstanding any other provision of state law, including this |
|
chapter, a political subdivision may not adopt or enforce an order |
|
or ordinance pertaining to the subject matter of this code. |
|
(b) This chapter preempts all local ordinances, rules, or |
|
regulations adopted by a political subdivision of this state |
|
relating to employment. |
|
(c) An order or ordinance adopted by a county, municipality |
|
or political subdivision before the date this provision becomes law |
|
and that violates subsection (a) is null and void. |
|
(d) To the extent to which there is a conflict between this |
|
section and any other section of this Code, this section controls. |
|
SECTION 2. The following provisions of the Labor Code are |
|
repealed: |
|
(1) Section 21.151 |
|
SECTION 3. This Act takes effect September 1, 2015. |
