A BILL TO BE ENTITLED

AN ACT
|
|
|
relating to civil liability of the board of directors of the Brazos |
|
|
Valley Groundwater Conservation District. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter B, Chapter 8835, Special District |
|
|
Local Laws Code, is amended by adding Section 8835.056 to read as |
|
|
follows: |
|
|
Sec. 8835.056. LIABILITY. Notwithstanding Section |
|
|
101.001(2), Civil Practice and Remedies Code, for liability |
|
|
purposes only, a director is considered an employee under Chapter |
|
|
101, Civil Practice and Remedies Code. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2015. |
