A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the powers and duties of the West Travis County |
|
|
Municipal Utility District No. 5; providing authority to impose an |
|
|
impact fee. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 1214, Acts of the 71st Legislature, |
|
|
Regular Session, 1989, is amended by adding Section 6B to read as |
|
|
follows: |
|
|
Sec. 6B. IMPACT FEE. (a) Notwithstanding Section 395.011, |
|
|
Local Government Code, the district may assess an impact fee for new |
|
|
developments as defined by Section 395.001, Local Government Code, |
|
|
in an area outside of the district in which the district is |
|
|
authorized to provide potable and nonpotable water in Travis and |
|
|
Hays Counties. |
|
|
(b) Sections 49.212(d), (d-1), and (d-2), Water Code, do not |
|
|
apply to the district. |
|
|
SECTION 2. This Act takes effect September 1, 2015. |
