A JOINT RESOLUTION
|
|
proposing a constitutional amendment relating to the exclusive |
|
legislative duty to support and maintain an efficient system of |
|
public schools. |
|
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 1, Article VII, Texas Constitution, is |
|
amended to read as follows: |
|
Sec. 1. A general diffusion of knowledge being essential to |
|
the preservation of the liberties and rights of the people, it shall |
|
be the duty of the Legislature of the State to establish and make |
|
suitable provision for the support and maintenance of an efficient |
|
system of public free schools. The duty imposed by this section is |
|
the sole prerogative of the Legislature. Notwithstanding the rights |
|
and duties imposed by Article V of this constitution, the judicial |
|
branch of the State has no authority to interfere or issue a |
|
judgment or opinion on the actions of the Legislature implementing |
|
this section. |

SECTION 2. This proposed constitutional amendment shall be |
|
submitted to the voters at an election to be held November 3, 2015. |
|
The ballot shall be printed to permit voting for or against the |
|
proposition: "The constitutional amendment providing for the |
|
exclusive legislative duty to support and maintain an efficient |
|
system of public free schools." |
