A JOINT RESOLUTION
|
|
proposing a constitutional amendment authorizing certain elected |
|
county or district officeholders to become candidates for a |
|
countywide office of the same county without automatically |
|
resigning from the office already being held. |
|
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 65(b), Article XVI, Texas Constitution, |
|
is amended to read as follows: |
|
(b) If any of the officers named herein shall announce their |
|
candidacy, or shall in fact become a candidate, in any General, |
|
Special or Primary Election, for any office of profit or trust under |
|
the laws of this State or the United States other than the office |
|
then held or an office of the same county elected by the voters of |
|
the entire county, at any time when the unexpired term of the office |
|
then held shall exceed one year and 30 days, such announcement or |
|
such candidacy shall constitute an automatic resignation of the |
|
office then held, and the vacancy thereby created shall be filled |
|
pursuant to law in the same manner as other vacancies for such |
|
office are filled. |
|
SECTION 2. This proposed constitutional amendment shall be |
|
submitted to the voters at an election to be held November 3, 2015. |
|
The ballot shall be printed to provide for voting for or against the |
|
proposition: "The constitutional amendment authorizing certain |
|
elected county or district officeholders to become candidates for a |
|
countywide office of the same county without automatically |
|
resigning from the office already being held." |
