A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the access to certain medical test results by a grand |
|
|
jury. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 81.103(a), Health and Safety Code, is |
|
|
amended to read as follows: |
|
|
(a) A test result is confidential and is not subject to a |
|
|
subpoena, other than a grand jury subpoena. A person that possesses |
|
|
or has knowledge of a test result may not release or disclose the |
|
|
test result or allow the test result to become known except as |
|
|
provided by this section. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2015. |
