A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to a prohibition on a resident admission requirement for |
|
|
on-site inspections of assisted living facility license |
|
|
applicants. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 247.022, Health and Safety Code, is |
|
|
amended by adding Subsection (d) to read as follows: |
|
|
(d) The department may not require an assisted living |
|
|
facility license applicant to admit a resident to the facility |
|
|
before the department conducts an on-site health inspection. |
|
|
SECTION 2. The executive commissioner of the Health and |
|
|
Human Services Commission shall adopt rules to implement Section |
|
|
247.022(d), Health and Safety Code, as added by this Act, as soon as |
|
|
practicable after the effective date of this Act. |
|
|
SECTION 3. This Act takes effect September 1, 2015. |
