A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the recording of the presentment of an indictment by a |
|
|
grand jury. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Article 20.22(b), Code of Criminal Procedure, is |
|
|
amended to read as follows: |
|
|
(b) If the defendant is not in custody or under bond at the |
|
|
time of the presentment of indictment, the indictment may not be |
|
|
made public [and the entry in the record of the court relating to
|
|
|
the indictment must be delayed] until the capias is served and the |
|
|
defendant is placed in custody or under bond. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2015. |
