A BILL TO BE ENTITLED
 
AN ACT
  relating to recovery of costs for pilot programs to measure energy
  savings that result from water conservation programs.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 39.905, Utilities Code, is amended by
  adding Subsection (l) to read as follows:
         (l)  As part of an electric utility's energy efficiency
  incentive programs, an electric utility in conjunction with a
  municipally owned water utility may design and implement a pilot
  program to measure energy savings achieved as a result of the
  implementation of one or more water conservation programs
  administered by the water utility.  The electric utility may
  recover reasonable costs for the program through its energy
  efficiency cost recovery factor under Subsection (b)(1) in addition
  to the costs the electric utility would have otherwise recovered
  through the energy efficiency cost recovery factor.
         SECTION 2.  The Public Utility Commission of Texas shall
  adopt rules as necessary to implement Section 39.905(l), Utilities
  Code, as added by this Act, not later than January 1, 2016.
         SECTION 3.  This Act takes effect September 1, 2015.
