A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the use of state resources to implement or enforce the |
|
federal Patient Protection and Affordable Care Act. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Title 8, Insurance Code, is amended by adding |
|
Subtitle L to read as follows: |
|
SUBTITLE L. FEDERAL PATIENT PROTECTION AND AFFORDABLE CARE ACT |
|
CHAPTER 1691. IMPLEMENTATION OR ENFORCEMENT OF ACT PROHIBITED |
|
Sec. 1691.001. PROHIBITION ON USE OF PUBLIC RESOURCES. No |
|
funds, personnel, or other resources of the state or a political |
|
subdivision of the state may be used to enforce the Patient |
|
Protection and Affordable Care Act (Pub. L. No. 111-148), as |
|
amended by the Health Care and Education Reconciliation Act of 2010 |
|
(Pub. L. No. 111-152). |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2015. |
