A BILL TO BE ENTITLED
 
AN ACT
  relating to authorizing the Texas Parks and Wildlife Department to
  enter into certain contracts with private vendors.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter I, Chapter 11, Parks and Wildlife
  Code, is amended by adding Section 11.157 to read as follows:
         Sec. 11.157.  CONTRACTS WITH PRIVATE VENDORS. (a)  The
  department may contract with private vendors for the construction,
  maintenance, or operation of facilities such as lodges or
  recreation centers.
         (b)  A contract entered into by the department with a private
  vendor under this section:
               (1)  must comply with any law generally applicable to a
  contract for services entered into by the department; and
               (2)  must require the private vendor to render at least
  quarterly to the department periodic accounts that accurately
  detail all material transactions, including information reasonably
  required by the department to support fees that are collected by the
  vendor, and to regularly remit all money payable to the department
  under the contract.
         (c)  A contract entered into with a private vendor under this
  section may provide for the private vendor to recover all costs
  incurred by the vendor under the contract. After the vendor has
  recovered all of its costs incurred under the contract, the vendor
  and the department shall share in the revenue produced by the
  contract in proportions to be prescribed by the contract.
         (d)  An indebtedness, liability, or obligation of a private
  vendor incurred in the execution of a contract under this section
  does not create a debt or other liability of the department.
         SECTION 2.  This Act takes effect September 1, 2015.
