A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the recovery of certain expenses by an electric utility |
|
|
in a ratemaking proceeding; adding provisions subject to a criminal |
|
|
penalty. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 33.023, Utilities Code, is amended by |
|
|
adding Subsection (c) to read as follows: |
|
|
(c) An electric utility that recovers its reasonable costs |
|
|
of reimbursing the governing body's expenses under this section may |
|
|
recover the costs only on a uniform, system-wide basis. |
|
|
SECTION 2. Section 36.061, Utilities Code, is amended by |
|
|
adding Subsection (b-1) to read as follows: |
|
|
(b-1) Any amount approved as a cost or expense may be |
|
|
recovered by the electric utility only on a uniform, system-wide |
|
|
basis. |
|
|
SECTION 3. The change in law made by this Act applies only |
|
|
to a rate proceeding in which the initial hearing is held on or |
|
|
after the effective date of this Act. A proceeding in which the |
|
|
initial hearing is held before that date is governed by the law in |
|
|
effect immediately before the effective date of this Act, and that |
|
|
law is continued in effect for that purpose. |
|
|
SECTION 4. This Act takes effect September 1, 2015. |
