A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to a prohibition on local solid waste management |
|
|
regulations that are inconsistent with a permit or regulations of |
|
|
the Texas Commission on Environmental Quality. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 361.096, Health and Safety Code, is |
|
|
amended by amending Subsection (a) and adding Subsection (c) to |
|
|
read as follows: |
|
|
(a) Except as provided by Subsection (c) and as otherwise |
|
|
specifically provided by this chapter, this subchapter does not |
|
|
limit the powers and duties of a local government or other political |
|
|
subdivision of the state as conferred by this or other law. |
|
|
(c) Notwithstanding any other law, a local government or |
|
|
other political subdivision of the state may not adopt a rule or |
|
|
ordinance that conflicts with or is otherwise inconsistent with the |
|
|
requirements for solid waste management facilities as specified by |
|
|
the rules of the commission or by a permit issued by the commission. |
|
|
SECTION 2. This Act takes effect September 1, 2015. |
