A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the use of and training for incident-based reporting of |
|
|
information and statistics concerning criminal offenses committed |
|
|
in this state. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 411.042, Government Code, is amended by |
|
|
adding Subsection (k) to read as follows: |
|
|
(k) The department shall publish and periodically update on |
|
|
the department's Internet website incident-based information and |
|
|
statistics concerning criminal offenses committed in this state. |
|
|
SECTION 2. Subchapter D, Chapter 411, Government Code, is |
|
|
amended by adding Section 411.054 to read as follows: |
|
|
Sec. 411.054. INCIDENT-BASED CRIME STATISTICS REPORTING |
|
|
PLAN. (a) The department shall develop a plan for implementing and |
|
|
expanding the use of an incident-based reporting system by state |
|
|
and local law enforcement agencies to report information and |
|
|
statistics concerning criminal offenses committed in this state. |
|
|
(b) The plan described by Subsection (a) must: |
|
|
(1) build on available experience and infrastructure |
|
|
for reporting information and statistics concerning criminal |
|
|
offenses; |
|
|
(2) identify additional resource needs for |
|
|
implementing and expanding the use of an incident-based reporting |
|
|
system; |
|
|
(3) contain input from stakeholders, including other |
|
|
law enforcement agencies and law enforcement associations, |
|
|
advocacy groups, and academic institutions; |
|
|
(4) contain outreach strategies to educate the public |
|
|
on the differences between a summary reporting system and an |
|
|
incident-based reporting system; |
|
|
(5) contain measures to track the progress and success |
|
|
in this state of any incident-based reporting by state and local law |
|
|
enforcement agencies to the National Incident-Based Reporting |
|
|
System of the Uniform Crime Reporting Program of the Federal Bureau |
|
|
of Investigation, the Texas Incident-Based Reporting System of the |
|
|
department, or a successor program; and |
|
|
(6) examine the feasibility and desirability of |
|
|
purchasing or developing for state and local law enforcement |
|
|
agencies a records management system that meets the reporting |
|
|
requirements of the National Incident-Based Reporting System of the |
|
|
Uniform Crime Reporting Program of the Federal Bureau of |
|
|
Investigation, the Texas Incident-Based Reporting System of the |
|
|
department, or a successor program. |
|
|
(c) Not later than September 1 of each even-numbered year, |
|
|
the department shall submit the plan to the governor, lieutenant |
|
|
governor, speaker of the house of representatives, appropriate |
|
|
standing committees of the legislature, and Legislative Budget |
|
|
Board. |
|
|
SECTION 3. Section 1701.156, Occupations Code, is amended |
|
|
by adding Subsection (c) to read as follows: |
|
|
(c) The Department of Public Safety may use money |
|
|
appropriated to the department from the account to award grants to |
|
|
local law enforcement agencies for training on incident-based |
|
|
reporting systems to be used for reporting information and |
|
|
statistics concerning criminal offenses committed in this state. |
|
|
The department shall adopt rules governing the award of grants by |
|
|
the department under this subsection. |
|
|
SECTION 4. Section 1701.157, Occupations Code, is amended |
|
|
by adding Subsection (a-1) to read as follows: |
|
|
(a-1) Subsection (a) does not apply to money appropriated to |
|
|
the Department of Public Safety from the account for the purpose of |
|
|
awarding grants to local law enforcement agencies for training on |
|
|
incident-based reporting systems under Section 1701.156(c). |
|
|
SECTION 5. Not later than January 1, 2016, the Department of |
|
|
Public Safety shall adopt rules as required by Section 1701.156(c), |
|
|
Occupations Code, as added by this Act. |
|
|
SECTION 6. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2015. |
