A BILL TO BE ENTITLED
 
AN ACT
  relating to authorization for a school district board of trustees
  to grant charters for the establishment of certain charter schools.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter C, Chapter 12, Education Code, is
  amended by adding Section 12.0523 to read as follows:
         Sec. 12.0523.  CHARTER OPERATED BY DISTRICT. (a)  The
  commissioner by rule shall authorize a school district board of
  trustees to grant a charter for the establishment of a charter
  school in accordance with this section. 
         (b)  A charter school established under this section is
  administered by the superintendent of the school district granting
  the charter.  The governing body of the charter school is the board
  of trustees of the school district granting the charter. 
         (c)  The commissioner shall adopt rules for the operation of
  a charter school established under this section relating to:
               (1)  a process through which the charter school
  requests and obtains from the State Board of Education waivers from
  otherwise applicable provisions of this code;
               (2)  a school district's ability to sell or otherwise
  dispose of the charter;
               (3)  intellectual property rights belonging to a school
  district that established the charter school;
               (4)  a student enrollment process;
               (5)  employment of teachers; and
               (6)  the allocation of funding generated by students
  attending the charter school.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution. If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2015.
