A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to permits to be issued for the storage and disposal of |
|
certain oil and gas waste. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter D, Chapter 91, Natural Resources |
|
Code, is amended by adding Section 91.118 to read as follows: |
|
Sec. 91.118. PERMITS REQUIRED FOR COMMERCIAL STORAGE AND |
|
DISPOSAL FACILITIES. (a) The commission by rule shall regulate |
|
through the issuance of permits the commercial storage and disposal |
|
of oil and gas wastes. |
|
(b) Rules adopted under this section must provide: |
|
(1) that a permit application must include: |
|
(A) a land use analysis for the area within a |
|
one-mile radius of the proposed site that includes information |
|
regarding: |
|
(i) stormwater facilities; |
|
(ii) the results of soil testing; |
|
(iii) the locations of schools, hospitals, |
|
and residences; |
|
(iv) water resources; and |
|
(v) geology and hydrogeology; |
|
(B) a site development plan that includes: |
|
(i) design documents; |
|
(ii) a groundwater monitoring plan; and |
|
(iii) a stormwater management plan; and |
|
(C) a site operating plan that includes operating |
|
hours and procedures for: |
|
(i) facility operation; |
|
(ii) recordkeeping; |
|
(iii) litter and leachate management; |
|
(iv) special waste handling; and |
|
(v) site closure; |
|
(2) criteria for issuance and denial of a permit, |
|
including criteria to determine whether to require a buffer zone |
|
around the facility; and |
|
(3) requirements to obtain a bond, as described by |
|
Section 91.109. |
|
SECTION 2. Not later than January 1, 2016, the Railroad |
|
Commission of Texas shall adopt rules as required by Section |
|
91.118, Natural Resources Code, as added by this Act. |
|
SECTION 3. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2015. |
