A JOINT RESOLUTION
|
|
proposing a constitutional amendment authorizing the legislature |
|
to nullify an order, rule, policy, or similar measure adopted by the |
|
executive branch of the federal government that exceeds the |
|
authority granted by the United States Constitution. |
|
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Article III, Texas Constitution, is amended by |
|
adding Section 68 to read as follows: |
|
Sec. 68. The legislature without the approval of the |
|
governor may nullify an executive order, agency rule or policy, or |
|
similar measure adopted by an official or entity within the |
|
executive branch of the federal government, if the legislature by a |
|
vote of two-thirds of the membership of each house determines that |
|
the order, rule, policy, or measure exceeds the authority granted |
|
to the executive branch by the United States Constitution. An |
|
order, rule, policy, or measure nullified by the legislature has no |
|
legal effect in this state and may not be enforced or recognized as |
|
having legal effect by this state or a political subdivision of this |
|
state. |
|
SECTION 2. This proposed constitutional amendment shall be |
|
submitted to the voters at an election to be held November 3, 2015. |
|
The ballot shall be printed to permit voting for or against the |
|
proposition: "The constitutional amendment authorizing the |
|
legislature to nullify an order, rule, policy, or similar measure |
|
adopted by an official or entity within the executive branch of the |
|
federal government that exceeds the authority granted to that |
|
branch by the United States Constitution." |
