No significant fiscal implication to the State is anticipated.
The bill would create the joint legislative committee on constitutional powers and enforcement. The bill allows the committee to review any federal action to determine whether the action is an unconstitutional federal action. The bill would require the committee to submit a report to the Governor, the Attorney General, Speaker of the House of Representatives and the Lieutenant Governor on certain federal actions. The bill would permit the Attorney General to represent the state in an action regarding the refusal or failure of the state or political subdivision to participate in the implementation of an unconstitutional federal action.
The Office of Attorney General anticipates any additional work resulting from the passage of the bill could be reasonably absorbed within current resources.
