FISCAL NOTE, 84TH LEGISLATIVE REGULAR SESSION

April 18, 2015

TO:
Honorable Abel Herrero, Chair, House Committee on Criminal Jurisprudence

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
HB259 by Miles (Relating to forfeiture of property used in the commission of certain littering offenses.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would broaden the definition of "contraband" for purposes of the forfeiture of property used in the commission of certain offenses and would clarify that when a defendant is convicted of certain misdemeanor offenses, the court is required to provide notice to the defendant that subsequent convictions of the offense(s) may result in forfeiture of their vehicle. Based on the analysis of the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
