LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 84TH LEGISLATIVE REGULAR SESSION

May 27, 2015

TO:
Honorable Joe Straus, Speaker of the House, House of Representatives

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
HB324 by Dutton (Relating to a requirement that a peace officer obtain a search warrant before conducting a body cavity search during a traffic stop.), As Passed 2nd House

No fiscal implication to the State is anticipated.

The bill would amend the Code of Criminal Procedure to prohibit a peace officer from conducting a body cavity search during a traffic stop unless the officer first obtains a search warrant authorizing the body cavity search. This analysis assumes the provisions of the bill could be implemented within existing resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
