HB326 by Wu (relating to information provided by electronic means in support of the issuance of a search warrant.), Committee Report 1st House, Substituted
No significant fiscal implication to the State is anticipated.
The bill would amend the Code of Criminal Procedure to permit a magistrate to accept and may consider a sworn statement provided by telephone or electronic communication for purposes of issuing a search warrant and sets out the procedures that must be followed when an applicant for a search warrant attests to the contents of an affidavit submitted by reliable electronic means.
Based on the analysis of the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.
