LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 84TH LEGISLATIVE REGULAR SESSION

April 28, 2015

TO:
Honorable Abel Herrero, Chair, House Committee on Criminal Jurisprudence

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
HB341 by Dutton (Relating to the extent of a defendant's criminal responsibility for the conduct of a coconspirator in certain felony cases.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Code of Criminal Procedure to prohibit a sentence of death for a defendant found guilty of a capital felony through criminal responsibility for the conduct of another. The Office of Court Administration indicates it does not anticipate a significant fiscal impact to the state court system as a result of implementing the provisions of the bill. The Office of Capital Writs indicates it does not anticipate a significant fiscal impact a result of implementing the provisions of the bill. This analysis assumes implementing the provisions of the bill would not result in a significant impact on state correctional agencies.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
