IN RE:
HB460 by Bell (relating to the issuance of a search warrant for taking a blood specimen from certain persons suspected of committing certain intoxication offenses.), Committee Report 1st House, Substituted
No significant fiscal implication to the State is anticipated.
The bill would amend the Code of Criminal Procedure to permit warrants for blood specimens in intoxication offense cases to be issued from a magistrate with jurisdiction in the county in which the suspect was stopped or from a magistrate in a county contiguous to the county in which the warrant was issued if the officer attempted and was unable to obtain a warrant from a magistrate serving in a criminal court in the county in which the suspect was stopped. Based on the analysis of the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.
Local Government Impact
No significant fiscal implication to units of local government is anticipated.
