No significant fiscal implication to the State is anticipated.
The bill would amend Chapter 157 of the Family Code to prevent a court from confining a respondent for failure to pay child support if the respondent brings evidence to the hearing which indicates that the respondent is current in payment of child support. However, the court may still hold the respondent in contempt of court and, if the respondent has been held in contempt of court for failure to pay child support in the past 24 months, the court may confine the respondent.
The Department of Family and Protective Services does not anticipate any fiscal impact as a result of implementing this bill.
The Office of Court Administration does not anticipate any significant fiscal impact to the state court system resulting from the bill.
The bill would take effect on September 1, 2015.
Local Government Impact
No significant fiscal implication to local courts is anticipated.
