LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 84TH LEGISLATIVE REGULAR SESSION

May 21, 2015

TO:
Honorable John Whitmire, Chair, Senate Committee on Criminal Justice

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
HB710 by Turner, Sylvester (Relating to procedures for certain persons charged with a violation of a condition of release from the Texas Department of Criminal Justice on parole or to mandatory supervision.), As Engrossed

No significant fiscal implication to the State is anticipated.

The bill would amend the Government Code to permit the Texas Department of Criminal Justice to issue a summons requiring an individual to appear for a hearing instead of a warrant for certain individuals as described in the bill. Under the provisions of the bill, after the determination is made, a warrant may be issued requiring the releasee to be held in county jail pending transfer to an intermediate sanction facility or the institution from which the individual was released.

Local Government Impact

There would be cost savings to counties due to reduced jail populations. The savings to a county would depend on the number of individuals given a summons under the provisions of the bill.

According to the Texas Commission on Jail Standards, the average cost for an inmate in a county jail is $60.01 per day.
