No significant fiscal implication to the State is anticipated.
The bill would amend the Code of Criminal Procedure to require the dismissal of cases with prejudice for any offense within municipal court jurisdiction if a peace officer fails to appear in connection with the offense when the case is called for trial and would prohibit the continuance of a case for the sole reason of the officer's failure to appear. Based on the analysis of the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.
