FISCAL NOTE, 84TH LEGISLATIVE REGULAR SESSION

April 13, 2015

TO:
Honorable John T. Smithee, Chair, House Committee on Judiciary & Civil Jurisprudence

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
HB750 by Frullo (Relating to a landowner's liability for certain aviation activities on or above the owner's land.), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would amend the Civil Practice and Remedies Code to define "recreational aviation activities" for the purposes of a premises liability and expands the definition of recreation activities to include recreational aviation activities. The bill specifies certain types of recreational aviation activities such as those taking place on or above land that is not owned by a governmental unit, not held open to the public for recreational aviation activities, and for which the owner or occupant of the land does not charge. Based on the analysis of the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
