LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 84TH LEGISLATIVE REGULAR SESSION

April 22, 2015

TO:
Honorable Allen Fletcher, Chair, House Committee on Emerging Issues In Texas Law Enforcement, Select

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
HB1035 by Johnson (Relating to criminal offenses involving the filming, recording, photographing, documenting, or observing of a peace officer.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Penal Code relating to criminal offenses involving filming, recording, photographing, documenting, or observing a peace officer. Under the provisions of the bill, a law enforcement officer or employee of a law enforcement agency that alters, destroys, or conceals certain audio or visual recordings without the written consent of the owner would commit an offense punishable as a third degree felony.

The Office of Court Administration and Department of Public Safety indicate the provisions of this bill would not result in a significant fiscal impact to the State. This analysis assumes implementing the provisions of the bill would not result in a significant impact on state correctional agencies.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
