FISCAL NOTE, 84TH LEGISLATIVE REGULAR SESSION

May 20, 2015

TO:
Honorable John Whitmire, Chair, Senate Committee on Criminal Justice

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
HB1036 by Johnson (Relating to reporting requirements for certain injuries or deaths caused by peace officers and for certain injuries or deaths of peace officers.), Committee Report 2nd House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would amend the Code of Criminal Procedure to require the Office of the Attorney General to create forms for certain agencies to report injuries or deaths related to peace officers no later than October 1, 2015.  The bill would take effect September 1, 2015.

Based on the LBB's analysis of the Office of the Attorney General, duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.  The Department of Public Safety indicated the costs associated with implementation of the bill could be absorbed with existing resources.

Local Government Impact

There may be costs to local law enforcement agencies for additional reports sent to the Office of the Attorney General within a certain time frame. The Harris County Sherriff's office estimates an operational cost of $13,000 per year for additional hours needed to prepare and file paperwork.
