FISCAL NOTE, 84TH LEGISLATIVE REGULAR SESSION

May 8, 2015

TO:
Honorable John T. Smithee, Chair, House Committee on Judiciary & Civil Jurisprudence

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
HB1102 by Thompson, Senfronia (Relating to the statute of limitations for a suit for personal injury arising from certain offenses constituting sexual abuse of a child.), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would amend the Civil Practice and Remedies Code to increase the statute of limitations from five years to 15 years for the filing of a suit for personal injury for injuries arising from certain offenses constituting sexual abuse of a child and would retain a five year statute of limitations for suits for personal injury arising from sexual assault, aggravated sexual assault, trafficking of persons, or compelling prostitution offenses involving adults. Based on the analysis of the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
