No significant fiscal implication to the State is anticipated.

The bill would amend the Code of Criminal Procedure regarding the statement or affidavit provided to support the issuance of a search warrant. The bill would provide that a magistrate could accept a sworn statement by telephone or electronic communication for purposes of setting forth substantial facts showing probable cause for a search warrant's issuance, provided an oath is administered and the statement is electronically recorded and promptly transcribed. Based on the analysis of the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.
