Honorable Richard Peña Raymond, Chair, House Committee on Human Services
FROM:
Ursula Parks, Director, Legislative Budget Board
IN RE:
HB1337 by Naishtat (Relating to requiring institutions and assisted living facilities to maintain guardianship orders of residents.), Committee Report 1st House, Substituted
No significant fiscal implication to the State is anticipated.
The bill would amend the Health and Safety Code to require that certain institutions request a copy of a court order appointing a guardian of a resident or a resident's estate and maintain the copy of the court order in the resident's medical records. The bill would require the Department of Aging and Disability Services (DADS) to inspect a court order appointing a guardian of a resident who is the subject of an abuse, neglect, or exploitation investigation. DADS indicates that it could absorb the costs associated with the bill within its current resources.
Local Government Impact
No fiscal implication to units of local government is anticipated.
