No significant fiscal implication to the State is anticipated.

The bill would amend the Penal Code as it relates to the prosecution of the offense of sexual assault committed against certain victims. The bill would provide an additional condition to qualify for an existing affirmative defense to prosecution for the offense of sexual assault. This analysis assumes implementing the provisions of the bill would not result in a significant impact on state correctional agencies.
