FISCAL NOTE, 84TH LEGISLATIVE REGULAR SESSION

March 22, 2015

TO:
Honorable Joe Deshotel, Chair, House Committee on Land & Resource Management

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
HB1422 by Lozano (Relating to the restoration of expired eminent domain authority of rural rail transportation districts.), As Introduced

No fiscal implication to the State is anticipated.

The bill would amend the Transportation Code to permit rural rail transportation districts, whose power to exercise eminent domain expired under Section 2206.101(c) to exercise the power of eminent domain.

Local Government Impact

There could be a fiscal impact to local entities; however the amount cannot be determined. The fiscal impact on a local entity would vary depending on which rural rail transportation district exercises eminent domain and the amount of land obtained.
